Criminal Matters in New Jersey are divided into two (2) categories:
Crimes and D
isorderly Persons Offenses.
Crimes range in degree from 1st to 4th with the penalty of incarceration as follows:
- 1st Degree Maximum of 20 Years (Presumption of Incarceration)
- 2nd Degree Maximum of 10 Years (Presumption of Incarceration)
- 3rd Degree Maximum of 5 Years
- 4th Degree Maximum of 18 months
- Disorderly Person Offense Maximun of 6 months
- Petty Disorderly Offense Maximun of 30 days
All offenses come with fines and the potention of community service, probation and drug and alcohol abuse assessments. First time offenders may be entitled to Pre-Trial Intervention (PTI) or a Conditional Discharge (CD). Under PTI or CD the charges are held in obeyance and the client is permitted to demonstrate to the Court that he/she can stay out of trouble for a period of time. If successful, the charges are ultimately dismissed and can be expunged!
